HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claimed to have submitted application on 26.06.2014 for grant of quarry lease in the private patta land belonging to him. Petitioner also claims that No Objection Certificate issued by the Tahsildar of Owk Mandal, Kurnool District was also submitted, but so far there is no further development and in spite of making several requests, the application is not processed and finalized and licence as sought for is not granted. This writ petition is filed alleging deliberate and willful inaction on the part of the competent authority in considering the application, even though the same is submitted more than two years back. 2.

No reasons are forthcoming as to why this application is kept pending. If what is contended by the petitioner is true, then such action of the competent authority in keeping the application pending cannot be appreciated and it amounts to sitting over the application without any justification.

Without expression any opinion on merits, this writ petition is disposed of directing the Assistant Director of Mines and Geology (3rd respondent) to consider and pass appropriate orders on the representation stated to have been submitted by the petitioner on 26.06.2014, if the same is in order and is pending, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order. If petitioner is aggrieved by the

decision of the competent authority, it is open to him to avail appropriate remedies as available in law.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
