HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.28063 of 2013 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Home for the respondents. The prayer sought in the writ petition is as under: "... to issue an appropriate writ or order or direction more particularly in the nature of writ of mandamus declaring the inaction of the respondents 1, 2 and 3 and more particularly respondent No.4 who has failed to register any crime of the offence which took place on 16.09.2013 as illegal, arbitrary and against the principles of the natural justice and abuse of process of law, colorable exercise of official powers and violative of Articles 14 and 21 of the Constitution of India thereby consequently direct the respondent No.4 to register crime of the offence dated 16.09.2013 and proceed with the investigation as per law."

During the course of hearing, it is brought to the notice of this Court that pursuant to the complaint lodged by the petitioner a case in Crime No.787 of 2013 for the offence punishable under Section 325 read with Section 34 IPC was registered on 17.09.2013. After completion of investigation, final report was filed before the III Additional Chief Metropolitan Magistrate, Hyderabad. It is further brought to the notice of this Court that after trial the matter ended in acquittal on 07.04.2018.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition. Accordingly, the writ petition is dismissed. No order as to costs.
