THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.23234 OF 2015 ORDER:

The case of the petitioners is that the sale deed executed by them on 03.05.2006 is registered as pending document No.P150/2006 with regard to Survey Nos.11 and 11/1 admeasuring Ac.15.00 cents and Ac.4.00 cents respectively at Nagasanipalli Village Gram Panchayat, Kazipet Mandal, Kadapa District. In spite of lapse of so many years, the Joint Sub-Registrar, Kadapa, the 3rd respondent, has neither communicated any reasons for keeping the document pending nor took any steps for release of the document. The petitioners, therefore, question the action of the 3rd respondent in not completing the process of registration.

Learned Government Pleader for Revenue did not get instructions, in spite of granting time.

The petitioners' state that the legal notice, dated 01.07.2015, issued by their learned counsel to the 3rd respondent did not yield any result and as no action was taken by the respondents, they approached this Court.

Keeping in view the facts and circumstances as above, it is necessary for the 3rd respondent to re-examine the petitioners' aforesaid pending document and register and release the same, if the

same is in compliance with the Indian Stamp Act and the Indian Registration Act. It is also made clear to the 3rd respondent that if there are any objections with regard to the registration and release of the said document, he shall intimate the same to the petitioners within a period of two weeks from the date of receipt of a copy of this order, failing which the document shall be registered and released as directed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
