HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.6162 of 2018 ORDER:

The revision is maintained impugning the docket proceedings of the learned trial Judge in I.A.No.276 of 2018 granting ad interim ex parte interim injunction, dated 28.03.2018, in the suit for bare injunction in O.S.No.158 of 2018 (on the file of the Principal Junior Civil Judge, Anantapuramu) and after appearance of respondents and from their filing of counter by R.5 adopted by others on 30.07.2018, interim order again extended pursuant to the earlier extensions time to time and again on 11.09.2018 for enquiry on petition interim order is extended till 26.12.2018, aggrieved thereby.

Heard before admission and before ordering notice to the respondents and once the respondents to the injunction petition are ready for hearing, and the ad-interim ex parte injunction was obtained by the plaintiffs/petitioners, it is the duty of the trial Judge to dispose of the injunction application on merits, as early as possible. 3.

Having regard to the above, the civil revision petition is disposed of, before admission and before ordering notice to the respondents, by directing the trial Judge to advance the hearing after notice to the petitioners, by virtue of this order, and dispose of the injunction application on merits, as early as possible, as per the mandate of Order XXXIX Rule 3 C.P.C.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
