Heard both sides.

Once the relief of declaration with partition sought for by amendment of the suit from permanent injunction, suit originally filed for the bare prohibitory injunction that too when the record shows Government is the owner and the so called patta claimed by the plaintiff as granted by the Government on 30.04.2010 shown cancelled, thereby what the lower Court observed that the Government is necessary party to consider the amendment is correct and there is nothing to interfere, however it will not prevent if at all after Government is impleaded to file any such petition if law permits.
