HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5858 of 2015 O R D E R :

The petitioner, who is the accused No.2 in Crime No.164 of 2015 of Humayun Nagar Police Station, Hyderabad, registered for the offence under Section 420 I.P.C., filed this petition under Section 438 of Cr.P.C., seeking anticipatory bail.

The allegation against the petitioner is that he is running a parallel Government with all Government seals and certificates. The said fact came to light in view of the confession given by accused No.1.

Custodial interrogation is necessary in the present case. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. However, the petitioner-accused No.2 is directed to surrender before the police concerned and move an application for bail before the trial Court and on such application being filed, the trial Court is directed to consider the same favourably on the facts and circumstances of the case.
