HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38088 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents in not allowing the petitioner to make construction in accordance with the permission granted in his favour on 30.7.2018, as illegal and arbitrary.
Though various grounds are raised, learned counsel for the petitioner submits that though the petitioner is having a sanctioned plan for ground plus two floors, which was granted on 30.7.2018, the respondent-authorities are preventing him in proceeding further with the construction.
Learned Standing Counsel for the Corporation would submit that the respondent-authorities are not interfering with the constructions of the petitioner, but, however, as the petitioner is deviating from the sanctioned plan, by not leaving sufficient set backs, steps are being taken to remove the same, in accordance with law. Having regard to the facts and circumstances of the case, the writ petition is disposed of giving liberty to the respondents to take steps for violations, if any made by the petitioner, while constructing the building in the subject premises and that there shall be no interference by the respondents except in accordance with law.
As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
