HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 315 OF 2015 ORDER:

Heard learned counsel for petitioners and at the admission stage, the following order is passed.

I have perused the FIR as well as statements of LW-2 - K. Surya Narayana Reddy and LW-3 - K. Mallikarjuna Reddy, who were said to be the eyewitnesses to the incident, and they would show a strong prima facie case against the accused. Investigation is reported to be pending. In these circumstances, it is not a fit case to quash the proceedings. Therefore, investigation shall be continued to its logical end. However, during the course of investigation, the police of Sanjamala Police Station, Kurnool District, are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C towards the petitioners/A2 & A3. Petitioners/A2 & A3 shall cooperate with the investigating agency for smooth completion of investigation. Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
