THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.38070 of 2018 ORDER:
The grievance of the petitioner in this case is that the Tahsildar, Maheswaram Mandal, Ranga Reddy District, is not updating the revenue records in relation to the land admeasuring Acs.2.08 guntas in Survey No.137/A of Mansanpally Village, Maheswaram Mandal, Ranga Reddy District, pursuant to his application.
Perusal of the record reflects that the petitioner submitted application dated 01.02.2018 which was received by the Tahsildar's office on 07.02.2018. Therein, the petitioner stated that his father was the owner of the subject property but after his death, one of the brothers of the petitioner sold away the entire extent without authorization. According to the petitioner, he and his other brothers also have rights in the lands sold away and therefore, he sought correction of the entries made in the revenue records.
It is not within the ken of the revenue authorities to set aside any alienation made in accordance with the due procedure. It is also not open to them to resolve disputed questions of title. The Telangana Rights in Land and Pattadar Pass Books Act, 1971, only allows a limited scope of enquiry into issues of title when such a dispute arises in the context of entries in revenue records. Therefore, the very representation made by the petitioner on 01.02.2018, received on 07.02.2018, was misconceived. The inaction attributed to the Tahsildar in the context of the said representation does not warrant interference. The writ petition is accordingly dismissed on this short ground. This order shall however not preclude the petitioner from invoking appropriate
remedies available to him in law in accordance with the due procedure before the competent forum.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
