HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.8369 of 2016 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue for respondents. Petitioners' grievance is that they had filed an appeal before respondent No.3 in August, 2015 along with stay application, challenging the order of resumption passed by respondent No.4 on 31.03.2015 in respect of the subject land, but respondent No.3 is not disposing of the said appeal or the stay petition even though six months time is elapsed since then.

Learned Government Pleader appearing for respondents states that respondent No.3 will dispose of appeal, within six months and also the stay petition expeditiously.

Having regard to the grievance expressed by the petitioners that respondent No.3 might not pass any orders in the stay application, since he has not done so for the last four months, there shall be stay of eviction of the petitioners pursuant to the order passed by

respondent No.4 till the appeal filed by the petitioners before respondent No.3 is disposed of. Respondent No.3 shall dispose of the appeal as expeditiously as possible, preferably within six months from the date of receipt of a copy of this order.

With the above observations and directions, this Writ Petition is disposed of. No costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
