THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42153 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner states that he is the absolute owner and possessor of the agricultural land admeasuring Ac.1.96 cents in Survey No.1377/2-1 of China Aluru Village, Kaligiri Mandal, Nellore District. The petitioner made a representation to the District Collector, Nellore District, the 2nd respondent, pointing out that instead of his name, some other's name is illegally entered in the revenue records. Based on the said representation, the 2nd respondent vide his proceedings No.E7/4998/2015, dated 16.10.2015, directed the Tahsildar, Kaligiri Mandal, Nellore District, the 3rd respondent, to conduct a detailed enquiry and submit reasons for change of name in the revenue records. Alleging that no action has been taken by the respondents, the present Writ Petition is filed. In view of the fact that the 2nd respondent has already directed the 3rd respondent to conduct enquiry and take appropriate action, the 3rd respondent is duty bound to complete the enquiry and pass appropriate orders and also send necessary report to the 2nd respondent without further loss of time.

The Writ Petition is accordingly disposed of directing the 3rd respondent to conduct enquiry, consider the respective claims and pass appropriate orders after notice to all the parties, and send a report to the 2nd respondent within a period of six weeks from the date of

receipt of a copy of this order. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
