THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.1778 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

2. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondents 2 to 4 in taking proper action as per law and existing rules basing on the representations made by the petitioner in Revenue Sadassu on 27.01.2012 and Janma Bhoomi on 02.12.2013 as illegal and arbitrary and consequently to direct respondents 2 to 4 to take proper action by enquiring the matter basing on the above said representations made by the petitioner to restore the possession as per Section 4(1)(b) of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977.

3. Though various grounds are raised in the affidavit filed in support of the writ petition, learned counsel for the petitioner submits that the representations submitted to the authorities are not considered and as such, a direction is sought for considering the said representations at the earliest.

4. Learned Government Pleader for Revenue did not dispute the same, provided the authorities shall hear all the aggrieved persons.

5. Without going into the merits of the case and having regard to the submissions made, the Writ Petition is disposed of directing

the 4th respondent-Tahsildar to dispose of the representations made by the petitioner in Revenue Sadassu on 27.01.2012 and in Janma Bhoomi on 02.12.2013, at the earliest, preferably within a period of eight (08) weeks from the date of receipt of a copy of this order, if they are still pending consideration. It is needless to mention that the authorities shall hear the petitioner and the 5th respondent before passing any order on the representations. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
