THE HONOURABLE SRI JUSTICE D.V.S.S.SOMAYAJULU CIVIL REVISION PETITION No. 27 of 2014 ORDER:

This Civil Revision Petition is filed, questioning the order dated 13.09.2013 passed in C.M.A.No.4 of 2013, by the First Additional District Judge, Srikakulam. When the Civil Revision Petition was filed in January 2014, a status quo order was granted, which is being continued as per both the learned counsel.

It is now revealed that the trial in the suit is in progress. Learned counsel admits that plaintiff evidence is already closed. The matter is now posted for defendants evidence.

In that view of the matter, this Court is of the opinion that passing any orders in the Civil Revision Petition is not really called for and the suit can be heard / disposed. Both the counsel are agreed to this proposal that the suit itself can be disposed of on merits. 4.

Therefore, without going into merits or de-merits of the matter, and while directing the status quo that was granted on 03.01.2014 to continue, the lower Court is directed to dispose of the suit as early as possible, preferably within a period of six (6) months from today in all respects. The lower Court should go and decide the matter finally without in any way being influenced by the status quo order that has

been granted by this Court. The status quo order will only last till the suit is finally decided.
