The Court made the following:
ORDER:
With the consent of the learned counsel for the petitioner, learned Government Pleader for Municipal Administration for the 1st respondent and the learned Standing Counsel for the Greater Hyderabad Municipal Corporation for respondents 2 to 4, this writ petition is disposed of at the admission stage.
2. The petitioner is a resident of Hussain Nagar, B.S. Maktha, Hyderabad. The grievance of the petitioner is that certain tent house material (scrap material) is dumped on the road in the colony, which is causing lot of inconvenience to the residents of the locality. The petitioner along with others of the locality have submitted representation, dated 07.03.2015, to the Additional Commissioner, GHMC (H&S), Tank Bund, Hyderabad, requesting him to take steps to remove the scrap material lying on the street of the colony. As seen from the letter, dated 07.03.2015, the concerned locality comes within Circle No.10, which is headed by the Deputy Commissioner and the Deputy Commissioner is arrayed as 3rd respondent. The writ petition does not disclose submission of copy of such representation to the Deputy Commissioner also.
3. The grievance of the petitioner necessitating institution of this writ petition is that in spite of submission of such representation, so far no action is taken.
4. Having regard to the same, without expressing any opinion on merits, the Writ Petition is disposed of giving liberty to the petitioner to submit a detailed representation to the Deputy Commissioner, Greater Hyderabad Municipal Corporation, Circle 10, Hyderabad (3rd respondent) ventilating his grievance and as and when such a representation is received, the 3rd respondent shall consider and take decision, as warranted by law. In the event of removing the alleged scrap material lying on the street of B.S. Maktha colony, the owner of the said material be also put on notice before taking any adverse decision. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. _________________ P.NAVEEN RAO, J
