HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38077 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 2nd respondent in not taking the action on the complaint dated 10.10.2018, lodged by the petitioner against the illegal construction undertaken by the respondents 3 and 4 over the plot of the petitioner admeasuring 150 sq. yards situated at Sy.No.895, near Pedda Shivalayam Temple, Mahabubnagar Town and District without obtaining any construction permission from the 2nd respondent, as illegal and arbitrary.

Though various grounds are raised, the learned counsel for the petitioner submits that the petitioner herein has submitted a representation on 10.10.2018 to the 2nd respondent-Commissioner stating that the respondents 3 and 4 are making constructions over the plot of the petitioner without having any permission from the Corporation and hence he prays to allow the writ petition. Learned Standing Counsel for the Corporation would submit that if the representation of the petitioner is pending consideration, the respondent-authority, may be directed to dispose of the same, in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 2nd respondent-Commissioner, to deal with the representation dated 10.10.2018, submitted by the petitioner and pass appropriate orders, in accordance with law, as early as possible preferably within a period of two to three weeks from the date of receipt of copy of this order, after giving reasonable opportunity of hearing to the petitioner and all concerned and then communicate a copy of the order to the petitioner.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
