ORDER:
This writ petition is filed for a mandamus to declare the inaction of respondent No.2 in taking steps on the petitioner's representation/complaint, dated 15.10.2015, against respondent No.4 for the alleged illegal and unauthorized constructions at plot No.1360 in survey No.1378 situated at Vavilalapalli, Karimnagar Municipal Corporation, as illegal and arbitrary.
This Court, by order, dated 14.12.2015, passed the following order:
"Learned Standing Counsel for Karimnagar Municipal Corporation, has candidly admitted that on 15.10.2015, respondent No.2 has received complaint from the petitioner about respondent No.4 allegedly constructing a compound wall encroaching the public road on the northern side and that action is contemplated.
This Court is unable to understand as to why respondent No.2 is displaying a total indifference to the petitioner's complaint, which, if found true, is serious in nature pertaining to encroachment of a public road.
The Commissioner of respondent No.2 is, therefore, directed to be personally present and explain the reason for his inertia in acting on the petitioner's complaint along with his counter-affidavit.
Post on 28.12.2015."
Today, at the hearing, Mr.Krishna Bhaskar, Commissioner of respondent No.2 Municipal Corporation is personally present. Mr.S.Sarath Kumar, learned Special Government Pleader (TS) representing him, has submitted that on the very day when the aforementioned order was passed, the present incumbent has taken over the charge of the Commissioner of respondent No.2 Municipal Corporation, that the copy of the said order of this Court was received by him on 19.12.2015 and that on 22.12.2015, the compound wall has been demolished. The Commissioner has assured this Court that hereafter, the Corporation will be very vigilant and sensitive to the
complaints made against the encroachments of public properties and constructions over private properties being made without sanctioned plan/in deviation of sanctioned plan and do the needful without giving scope for any complaint.
In the light of the above facts, the Writ Petition is disposed of as infructuous.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.52200 of 2015 filed by the petitioner for interim relief shall stand disposed of as infructuous.
