HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.12509 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the Government Pleader for the Civil Supplies for the State of Andhra Pradesh.

This writ petition is filed seeking writ of Mandamus declaring the action on the part of the respondents in not appointing the petitioner as Fair Price shop dealer on compassionate grounds as per G.O.Ms.No.4 dated 28.02.2014 and the recommendations of the 4th respondent dated 19.01.2015, as illegal and arbitrary.
3. The father of the petitioner was the permanent fair price shop dealer for shop No.59 at Vunukuru Village, Regidi Amadalavalasa Mandal of Srikakulam District. While working as a dealer, he expired on 09.12.2014.

Learned counsel appearing for the petitioner submits that by virtue of G.O.Ms.No.4 dated 28.02.2014, the dependants of the deceased fair price shop dealers, have to be considered for appointment as fair price shop dealers, on compassionate grounds subject to fulfilment of the conditions stipulated in G.O.Ms.No.4 dated 18.02.2014. Learned counsel further submits that based on the application submitted by the petitioner, the Mandal Revenue Inspector submitted a report dated 08.01.2015 to the 4th respondent-Tahsildar, who in turn after enquiry, submitted proposals to the 3rd respondent-The Revenue Divisional Officer, Palakonda, to consider the case of the petitioner for appointment as fair price shop dealer on compassionate grounds, but so far no action has been taken.

Having regard to the facts and circumstances of the case, the respondents are directed to consider the case of the petitioner based on the report submitted by the Mandal Revenue Inspector, which was forwarded by the 4th respondent to the 3rd respondent, seeking appointment as fair price shop dealer on compassionate grounds subject to his fulfilling the conditions stipulated in G.O.Ms.No.4 dated
28.02.2014, within a period of eight (8) weeks from the date of receipt of receipt of a copy of this order.
