HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 18178 of 2015 Order:

This Writ Petition was filed challenging the action of the respondents in not registering the case basing on the complaint dated 19.11.2012 given by the petitioner.

The allegations related to misappropriation of funds, corruption and tampering of records by the staff working in the office of the Superintendent of Police, Tirupati Urban Police District, Tirupati. It appears that the then Additional Superintendent of Police, Tirumala enquired into the matter and submitted a report to the third respondent on 08.02.2014. He found some of the allegations proved and indicated the officers responsible for the proved allegations. In spite of the same, the Superintendent of Police, Tirupati Urban Police District, Tirupati appears to have dropped the further proceedings by issuing the proceedings No.SP/Camp/MPR-1/2014 dated 17.07.2014;

(2) SP/Camp/MPR-2/2014 dated 17.07.2014; (3) SP/Camp/MPR-3/2014 dated 17.07.2014;

(4) SP/Camp/MPR-4/2014 dated 17.07.2014, (5) SP/Camp/MPR-5/2014 dated 17.07.2014 and (6) SP/Camp/MPR-6/2014 dated 17.07.2014 on the ground that the work load in the DPO is more and sufficient staff was not available. The said reasons cannot be proper reasons for dropping the charges against the delinquents. In the circumstances, the third respondent is directed to call for the record relating to the complaint of the petitioner dated 19.11.2012, peruse the report submitted by the then Additional Superintendent of Police dated 08.02.2014 and pass fresh orders by reviewing the orders already passed by the then Superintendent of Police, Tirupati Urban Police

District, Tirupati within a period of three (3) months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
