HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.5018 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.2 and 3 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.78 of 2015 of Mathukur, Nellore District registered for the offences punishable under Section 147, 148, 447, 427, 395, 397, 323 read with 149 I.P.C.

2) Heard the learned counsel for the petitioners/A-2 and A-3 and the 1st respondent-State represented by the Public Prosecutor before admission and before ordering notice to the 2nd respondent and perused the material on record.

3) There are no grounds to admit the application to quash the F.I.R but for the factual matrix entitles the petitioners who are the unmarried sisters of A-1 even taken for arguments that they are also present at the time of the occurrence; no overt acts attributed against them muchless hurling any abuses or instigation of the other accused.

4) Having regard to the above, as the accused entitled the concession of regular bail, the application is disposed of giving liberty to the petitioners/A-2 and A-3 to surrender before the learned Magistrate concerned and move for regular bail before the learned Sessions Judge with affidavit about the surrender and in such an event and after hearing the Public Prosecutor concerned, the learned Sessions Judge shall grant bail with necessary conditions at least by next day.

5) With the above observations, the Criminal Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in

this criminal petition shall stand closed.
