THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON Nos.38083,38090 AND 38096 OF 2018 COMMON ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioners are the unsuccessful applicants in O.A.Nos.1596, 1597 and 1619 of 2018 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. O.A.Nos.1596 and 1597 of 2018 were dismissed by the Tribunal, vide common order dated 04.10.2018, while O.A.No.1619 of 2018 was dismissed separately by order dated 13.08.2018. The grievance of the petitioners-applicants in the said O.As. was with regard to extension of revised pay scales to them as per Pay Revision Commission Report-2010. They sought a consequential direction to the authorities to accord monetary benefit to them in terms of the said revision.
Admittedly, this issue is under consideration with the authorities. The Director General of Police, Andhra Pradesh, addressed letter dated 22.10.2018 to the Principal Secretary to Government, Home Department, Government of Andhra Pradesh, adverting to this very issue and requested that a copy of the order dated 20.11.2012 passed by this Court in W.P.No.39090 of 2012 should be forwarded to enable him to take a final decision.
Sri D.Goverdhana Chary, learned counsel for the petitionersapplicants, would state that as his clients retired from service long ago, it is necessary that the authorities give priority to the issue and take a decision in the matter but the Tribunal was of the opinion that the petitioners-applicants should not be permitted to hustle the authorities in this regard.
Considering the fact that the authorities are seized of the matter and are yet to take a final decision, we are of the opinion that it would suffice at this stage if they are directed to act expeditiously. The writ petitions are accordingly disposed of directing the respondent authorities to expedite the process of consideration and take a final decision in the matter, duly keeping in mind the law laid down by this Court in W.P.No.29334 of 2016 and batch, following the edict of the Supreme Court in S.Banerjee v. Union of I ndia1. This exercise shall be completed at the earliest and in any event, not later than eight weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _________________ SANJAY KUMAR,J _________________ M.
