This writ petition is filed questioning the order passed by the 4th respondent which is a Welfare Association but not a State or its instrumentality within the meaning of 'State' under Article 12 of the Constitution of India and the maintainability of writ petition is challenged by the respondents in the counter itself.

Admittedly, the 4th respondent who passed the order is a Welfare Association and not a State or its instrumentality within the meaning of Article 12 of the Constitution of India. Therefore, writ petition is not maintainable under Article 226 of the Constitution of India. However, liberty is given to the petitioner to pursue his legal remedies in appropriate forum, if he desires.

With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
