ORDER

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the respondents in not releasing the retirement benefits viz., gratuity, leave salary and Group Insurance etc., to the petitioner even after his retirement i.e., 30.09.2001 as arbitrary and illegal and consequently to direct the respondents to pay all the retirement benefits with interest from 30.09.2001. Heard Smt N.Shoba, learned counsel appearing for the petitioner and Sri Srinivas Karra, learned Standing Counsel appearing for the 2nd respondent.

When the matter is taken up for hearing today, it is reported by the leaned Standing Counsel appearing for the 2nd respondent that all the retirement benefits of the petitioner have been settled and hence, the cause in the writ petition does not survive for adjudication.

Learned counsel appearing for the petitioner does not dispute the said submission.

Accordingly, the Writ Petition is dismissed. However, if certain amounts are not paid, the petitioner is at liberty to

pursue his remedies, before appropriate forum, in accordance with law. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
