It is the case of the petitioner that the land to an extent of Ac.0.40 cents in Sy.No.185/2 and Ac.0.48 cents in Sy.No.186 was allotted to him in family settlement by his father late Venkata Ranga Nayakulu on 01.12.1993. Since the date of settlement, he has been in possession and enjoyment of the same, without any interruption from whomsoever. While so, on 30.06.2016, the 3rd respondent along with his staff, tried to dispossess him from the subject property. On 07.07.2016, the 3rd respondent issued notice to the petitioner asking him to produce the relevant records in respect of the subject land on 12.07.2016. The petitioner appeared on the said date and produced the relevant records on the same day. However, on 12.07.2016, the 3rd respondent issued another notice asking the petitioner to appear before him on 16.07.

2016 along with relevant records to prove his right and possession over the subject land. However, on 14.07.2016, on the instructions of the 3rd respondent, the Village Revenue Officer, NChamavaram village visited the site along with JCB machine and tried to dispossess the petitioner from the subject land. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Learned Assistant Government Pleader for Revenue submits that in pursuant to notice dated 12.07.2016, the petitioner had not produced any documents.

The 3rd respondent, having issued notice dated 12.07.2016 asking the petitioner to appear before him, the 3rd respondent could have waited till 16.07.2016 to submit the documents. Instead of doing

so, he tried to dispossess the petitioner from the subject property. Even on 16.07.2016 the petitioner could have submitted the documents.

In view of the same, the petitioner shall submit the relevant documents along with explanation, within a period of 4 weeks from today. On such explanation, the 3rd respondent shall consider the same and pass appropriate orders in accordance with law. Till then, status quo obtaining as on today shall be maintained. However, if petitioner fails to file any explanation and submit documents, it is open for the respondents to take action in accordance with law. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
