HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRIT PETITION No. 38095 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the acts, deeds and things of the respondents in interfering with the peaceful possession and enjoyment of the immovable properties of the petitioners, situated in Gopalapuram, Velugumatla, Khammam Municipal Corporation, Khammam, for the purpose of widening the existing 33 feet wide road, without issuing any notice or conducting any enquiry or issuing any notification for acquisition of the properties of the petitioners or following any due process of law, are illegal and arbitrary. 2) The grievance of the petitioners appears to be that the respondent authorities are trying to widen the road by demolishing the compound walls of the house of the petitioners without following due process of law. 3) Smt.

M.Bhagyasree, learned Standing Counsel for respondent No.2 municipality, would submit that any action done by the authorities would only be in accordance with law. 4) Recording the said submission, the writ petition is disposed of, directing the respondents not to interfere with the subject properties in the context of road widening except

in accordance with the due procedure laid down by law. No order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
