THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 1747 OF 2016 O R D E R :

This Court, while disposing of Writ Petition No. 21182 of 2016, on 04.07.2016, directed the Revenue Divisional Officer, Chittoor, the respondent herein to conduct and complete the inquiry, keeping in view the principles of natural justice and taking into account and consideration the material that might be placed before him within a period of three weeks from the date of receipt of a copy of that order. The said order has not yet been complied with is the grievance of the petitioner in this Contempt Case. A counter-affidavit sworn to by the respondent has been filed in this Court, paragraph 8 of which reads as under: " I submit that I have received the orders of Hon'ble High Court on 09.09.2016 only and that I have issued notice to Sri A. Narasimha Yadav, S/o A. Anand, F.P.

Shop Dealer, the MPTC and Route Officer to attend enquiry before me on 15.09.2016 at 11.00 A.M. in Revenue Divisional Office, Chittoor for personal enquiry vide Roc.B/2176/2016, dt. 09.09.2016. Further I submit that the enquiry has been completed on 17.09.2016. The F.P. shop dealer/writ petitioner is exonerated. The suspension of authorisation ordered in this office Roc.B/2716/2016, dt. 26.05.2016 was revoked vide this office order Roc.B/2716/2016, dt.

19.09.2016 stocks were also allotted. The writ petitioner has given a statement to this effect also and expressed his willingness to withdraw the Contempt Case C.C.No.

1747/2016 in W.P.No. 21182/2016."

In view of the above averments contained in the counteraffidavit, learned Government Pleader for Civil Supplies (Andhra

Pradesh) submits that the order dated 04.07.2016 has been complied with. Hence, the Contempt Case stands closed. Consequently, the miscellaneous Applications, if any shall also stand closed.
