HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.11121 OF 2018 ORDER:
This Criminal Petition is filed by the petitioners/ A1 to A7 under Section 482 Cr.P.C, seeking to quash the proceedings in C.C.No.141 of 2017 on the file of the Judicial First Class Magistrate, Hindupur, where taken cognizance for the offences punishable under Sections 420, 465, 468, 471, 120-B r/ w 34 I.P.C., which is an outcome of Crime No.151 of 2015 of Hindupur Rural Police Station, Anantapur District.
Heard learned counsel for the petitioners and learned Public Prosecutor appearing for the State, before ordering notice to respondent No.2/ de facto complainant and perused the charge sheet, quash petition averments and the other material on record. On perusal of the material on record, there is nothing to quash the proceedings, but for, to file an application under Section 238 Cr.P.C., if there are any grounds for discharge before the learned Magistrate concerned to decide on its own merits. So far as the difficulty expressed by the petitioners/ A1 to A7 to attend the Court regularly is concerned, liberty is given to them by virtue of this order, to approach the learned Magistrate to move an application under Rule 37 of the Criminal Rules of Practice for one to represent others.
