THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.15755 OF 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner is the owner of land in Survey Nos.31/2, 31/5, 18.5, 18/2 and 19/3, which he purchased under Registered Sale Deed dated 27.08.1990. While so, respondent Nos.6 and 7 applied to the second respondent for conversion of their agricultural land into fish pond and a provisional registration was granted on 22.12.2014. The land of the petitioner is situated to the Western side of the land of respondent Nos.6 and 7.
The case of the petitioner is that by virtue of conversion of the agricultural land into fishpond there would be no channel for waste water to go outside. In the said circumstances, the present Writ Petition is filed challenging the action of the respondents in not following the guidelines under G.O.Ms.No.7 AH.DD&F dated 16.03.2013.
It is clear from the above facts that only provisional registration is granted to respondent Nos.6 and 7 and final registration is pending consideration before the first respondent. In the circumstances, the first respondent is directed to consider the objections of the petitioner before taking action for grant of final registration to respondent Nos.6 and 7. In case the first respondent comes to a conclusion that respondent Nos.6 and 7 are not entitled for final registration, they should also be issued a notice and heard along with the petitioner. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
