HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.562 OF 2016 ORDER:

This criminal petition under section 438 of the Code of Criminal Procedure is filed by the petitioners-accused seeking anticipatory bail in connection with Crime No.25 of 2013 on the file of Inspector of Police, Crime Investigation Department, Regional Office, Rajahmundry, registered for the offence under Sections 420, 468, 471 r/w 34 IPC.

The allegation against the petitioners herein is that they have obtained fabricated and fake MA English certificates in the name of University of Allahabad and used them as genuine for the purpose of getting promotions as School Assistant from Secondary Grade Teacher.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

Admittedly, the case was registered in the year 2013 and so far, the respondent-police have not chosen to arrest the petitioners herein.

Considering the above, this Court is inclined to grant anticipatory bail to the petitioner since it will not cause any prejudice for further investigation.

Hence, the petitioners-accused are directed to surrender before the Magistrate concerned on or before 02.02.2016 and on such surrender, they shall be enlarged on bail on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety each for the likesum to the satisfaction of the Magistrate concerned. Further the petitioners are directed to report before the Station House Officer concerned as and when required. The Criminal Petition is allowed accordingly.
