HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.38142 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 5th respondent for interfering with the peaceful possession and works of the petitioner's houses bearing Plot Nos.57 to 59 situated at Sy.Nos.141, 141/A, 141/e (as per revenue records Sy.Nos.141/A, 141/E/2, 141/E/4 and 4) of Chengi Cherla Revenue Village and Ghatkesar Mandal and now Medipalli Mandal of M.M District as illegal and arbitrary.

Though various grounds are raised, learned counsel for the petitioners submits that the respondent-authorities are trying to demolish the building structures raised in the subject premises without giving any opportunity to submit the explanations pursuant to the impugned notices dated 20.10.2018, issued to the petitioners and hence prays to direct the respondent-authority, to permit the petitioners to submit their respective explanations to the said notice and pass appropriate orders on the explanations.

Learned Standing Counsel for the Corporation would submit that no coercive steps will be taken till the explanations are submitted by the petitioners.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioners to submit their explanations to the notice dated 20.10.2018, within a period of three days from today, in which event, the respondent-authority shall deal with the same and pass appropriate orders, in accordance with law, at the earliest, preferably within a period of three to four weeks from the date of submission of explanation. Till such time, the respondent-authorities shall not interfere with the properties in dispute.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
