THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18545 of 2016 ORDER:

The grievance of the petitioner, as espoused in the Writ Petition, is that permission was not granted for construction of walls and slab on the Kummarigunta canal, which is in front of his land, situated in Sy.No.189 of Indukurpet, Bit-II, Kothur, SPSR Nellore Distrit.

Learned Government Pleader for Irrigation, on instructions, from the second respondent would submit that the application of the petitioner, for laying of slab over Kummarigunta kaluva over 50.15 mts length, was examined; and as per the letter dated 15.06.2016 of the Executive Engineer, Nellore Division, there already exists a bridge across Kummarigunta canal leading from Nellore to Mypadu, which is within the distance of 2 Kms from the petitioner's industry; and there is no provision for construction of bridges within 2 Kms.

The petitioner's representation dated 20.04.2016 for laying of 50.15 mts. length of slab over two retaining walls has since been considered and rejected, the second respondent may communicate the order to enable the petitioner to work out the remedies available to him under law.

The Writ Petition is, accordingly, dismissed. Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
