HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38148 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus directing the respondents to remove the encroachments existing on public road in Survey No.209/1, Kurnool town and maintain the master plan approved road connecting Nagendranath Reddy Colony to Kurnool Medical College Main Road, which is only the access to main road on the west side of the colony by declaring the inaction of respondents, in spite of the petitioners representations, in not initiating action to remove the encroachments on public road and maintain the master plan approved road, as illegal and arbitrary. 3) Though various grounds are raised, learned counsel for the petitioners would submit that the petitioner made a representation on 30.04.2018, seeking removal of encroachments made in Survey No.

209/1, Kurnool town and to maintain the approved master plan in respect of the road connecting Nagendranath Reddy Colony to Kurnool Medical College Main Road, in accordance with law, at the earliest. 4) Learned Standing Counsel would submit that if such application is made and is still pending consideration, the same would be dealt with at the earliest.

5) Having regard to the above, the writ petition is disposed of directing the respondents to deal with the application dated 30.04.2018, if made by the petitioner, and if the same is pending consideration, in accordance with law, as early as possible.
