HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.22449 of 2015 ORDER:
There is no representation on behalf of the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ or direction or an order which particularly in the nature of writ of mandamus declaring the inaction of the respondents 2 and 3 in not taking any action against the trespassers as made in the complaint dated 28.04.2015 in respect of the land in Sy.No.249/A/3 to an extent of Ac.0.26 guntas and Sy.No.250/A/3 to an extent of Ac.0.09 guntas situated at Pamulaparthi Village, Wargal Mandal, Medak District and to take approbation action by granting police protection to the petitioner to protect his property and life and liberty."
Learned Government Pleader appearing for the respondents brought to the notice of this Court that pursuant to the complaint lodged by the petitioner, a case in Crime No.80 of 2015 was registered. After investigation, a final report was filed referring the case as "civil in nature". If the petitioner has got any objections on the final report, the remedy available to him is by way of protest application before the very same Magistrate.
In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be dismissed.
Accordingly, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, shall also stand dismissed.
