THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.4015 of 2016 ORDER:

The petitioners filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of their arrest in connection with an unregistered Crime at Kushaiguda Police Station, Hyderabad District.

It is stated that the second respondent lodged a report against the petitioners before Kushaiguda Police Station for the offences punishable under Section 498 A of IPC and Sections 3 and 4 of Dowry Prohibition Act. Learned public prosecutor on instructions stated that no report is received by them till date.

Having regard to the facts and circumstances of the case, granting of anticipatory bail to the petitioners, at this stage, does not arise. But, however, if the Station House Officer, Kushaiguda Police Station registers any crime against the petitioners for an offence punishable under Section 498 A or for any matrimonial offence, which is punishable for a term of less than seven years, pursuant to the report given by the second respondent, he shall follow Section 41 of Cr.P.C.
