THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41355 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to call for the records in Crime No.276 of 2016 of Bethamcherla Town Police Station, Kurnool District, and to quash the same.
Heard and perused the material available on record. The case of the petitioner is that the 3rd respondent, who is working as daily labour in the stone quarry of the petitioner, lodged the present complaint alleging that on 18.11.2016 at 18.00 hours, the petitioner abused the 3rd respondent by touching his caste and also beat him with gear rod and cement brick and caused bleeding and dumb injuries and also threatened him with dire consequences. The said complaint was registered by the 2nd respondent in Crime No.276 of 2016 for the offences under Sections 324 & 506 IPC and Section 3(1)(r)(s) of the SCs & STs (POA) Act, 2015.
The main grievance of the petitioner is that the 3rd respondent has falsely lodged the present complaint without there being any incriminating material against the petitioner, but solely due to the earlier disputes and that the petitioner is innocent of the alleged offences with which he has been charged. Considering the grievance of the petitioner, the 2nd respondent is directed to complete the investigation in Crime No.276 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner.
concerned and execute a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the concerned Court for his future appearance before the concerned Court.
