THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.25734 OF 2016 O R D E R :

Heard counsel for the petitioner and the Government Pleader for Excise appearing for the respondents.

2. Petitioner's grievance is that the 3rd respondent had passed confiscation orders on 02.01.2016 in Cr.No.371/2015/B confiscating the petitioner's lorry bearing No.TS 05 UA 7357, and although he had filed an appeal before the 2nd respondent against the said order on 27.02.2016 along with a stay application, the 2nd respondent has not disposed of the said appeal or the stay application filed therein and in the meantime, the respondents 3 and 4 are attempting to sell the said vehicle.

3. The Government Pleader for Excise appearing for the respondents states that the 2nd respondent will dispose of the appeal pending before him within a period of two (02) months from the date of receipt of a copy of this order and communicate his decision thereon to the petitioner.

4. In view of the same, this Writ Petition is disposed of directing the 2nd respondent to decide the appeal filed by the petitioner on 27.02.2016 challenging the order dt.02.01.2016 of the 3rd respondent within a period of two (02) months from the date of receipt of a copy of this order and communicate his decision thereon to the petitioner. Till the appeal is disposed of, the subject vehicle shall not be sold. There shall no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall

stand dismissed.
