O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.291 of 2010 on the file of Judicial First Class Magistrate Court at Narsipatnam, registered against the petitioner, who is A-2, for the offences punishable under Sections 385, 386 and 506 (ii) r/w 34 IPC.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

A perusal of the complaint reveals that specific allegations were made against the petitioner and the case is under trial. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to scuttle the trial at this stage and quash the proceedings. The learned counsel for the petitioner submitted that as the petitioner was absent before the trial court on 6.1.2016 due to ill-health, non-bailable warrant was issued and that the same may be recalled. In the facts and circumstances of the case and the submissions of the learned counsel for the petitioner and the learned Additional Public Prosecutor, and having perused the material available on record, the criminal petition is disposed of directing the petitioner - accused No.

2 to approach the trial court and file a petition to recall the NBW issued against him and on such petition being filed, the trial court shall recall the NBW issued against him on the same day on his execution of personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum and further the petitioner shall appear before the trial court regularly. Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.
