O R D E R

This writ petition is filed for a writ of mandamus declaring the action of the respondent Nos.2 and 3 in not considering the application of the petitioner for building permission in respect of the premises bearing No.6-1-102 (Part), Padmarao Nagar, Secunderabad, as illegal and arbitrary and for a consequential direction to the respondents to consider the application of the petitioner in accordance with GHMC Act and its provisions. The case of the petitioner is that he is the owner and possessor of premises bearing No.6-1-102/G, 6-1-102/H, 6-1-102/I, situated at Padmarao Nagar, Secunderabad having purchased the same through the registered sale deed. It is also submitted that petitioner has made an application on 25.05.2012 to the respondent authorities seeking building permission along with the layout plan.

In pursuant to the same, the respondent officials addressed a letter dated 19.06.2012 to the petitioner, informing that they have received a complaint from Polbal Hanuman Temple with regard to construction permission, as such the file has been sent to the Head office along with the lay out plan for taking decision in the matter. But till today, no decision has been taken by the respondents. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner and Smt.

A.Deepthi, learned Standing Counsel for the respondents. Since it is stated that the petitioner's application for building permission is pending before the 3rd respondent, the 3rd respondent is directed to consider the same and pass appropriate orders, within a period of four (4) weeks from the date of receipt of a copy of this order, in accordance with law.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. _________________________ A.RAJASHEKER REDDY,J Date: 11.02.2015 dv
