THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39314 of 2016 ORDER:

Heard Sri P.Yasasvi for petitioners, the Assistant Government Pleader for Panchayat Raj & Rural Development for Respondents 1 to 5 and Sri Ravi Cheemalapati for Respondents 6 to 8.

Learned Standing Counsel places on record the procedure followed by the Committee constituted for the purpose of finalising the list of eligible candidates for grant of pension paid under various Schemes implemented by the State Government. He further makes a statement that the authorities have re-examined the claims and found that few of the petitioners are eligible and the pension of such eligible candidates will be restored. Learned counsel for petitioners submits that once the eligibility of petitioners was accepted and pension was continuously paid, either discontinuation or denial of pension ought to be in accordance with the fairness in action and the Government orders issued from time to time.

Basing upon such objection, he further contends that if the reasons are informed to petitioners, the petitioners will certainly satisfy the doubts entertained by the Authority and try to continue to get the pension.

The writ petition is disposed of by this order: The petitioners are given liberty to approach the Mandal Parishad Development Officer/Convener within ten days from today. The Mandal Parishad Development Officer/Convenor is directed to permit the petitioner (s) to inspect the report finalised by the Committee and also communicate the reason for such refusal. The petitioners thereafter are given two weeks' time to file representation together with supporting documents praying for restoration of the pension already granted to them. On such representation, the Mandal Parishad Development Officer/Convener is directed to complete the verification process and communicate the decision within four weeks from the date of such representation to petitioner(s). In cases, where eligibility is satisfied for continuance of pension, the respondents shall continue to pay the pension from the date on which it was discontinued. No costs.

Consequently, the miscellaneous petitions, if any shall stand closed.
