Learned counsel for the petitioner seeks permission to withdraw the present Criminal Petition as charge sheet is filed, calendar case number is assigned and the petition has become infructuous and that the petitioner intends to move similar application challenging the calendar case proceedings. Permission is, accordingly, granted.

Hence, the present Criminal Petition is dismissed as withdrawn leaving it open to the petitioner to exercise his right, if any, in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this petition shall stand closed.
