THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.11132 OF 2015 ORDER:
1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners/A.1 and A.2 in C.C.No.372 of 2013 on the file of the Court of the II Additional Judicial Magistrate of First Class, Khammam.
2 When the matter is taken up for hearing, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw the petition. He further requested the Court to dispense with the presence of the petitioners before the trial Court on each and every date of adjournment.
3 There is no dispute with regard to the identity of the petitioners who are accused Nos.1 and 2 in C.C.No.372 of 2013 on the file of the Court of the II Additional Judicial Magistrate of First Class, Khammam. Even if the presence of the petitioners is dispensed with, no prejudice will be caused to the 2nd respondent.
Accordingly, this criminal petition is dismissed as withdrawn, by dispensing with the presence of the petitioners who are accused Nos.1 and 2 in C.C.No.372 of 2013 on the file of the Court of the II Additional Judicial Magistrate of First Class, Khammam on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence so required. The trial Court is further directed to dispose of the case as expeditiously as possible, preferably, within a period of six months from the date of receipt of this order. 5 As a sequel, miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
