HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:
Petitioner claims to be the owner of Plot No.116 in MRC Colony, Tangelamudi, Eluru, West Godavari District. Petitioner alleges that the 4th respondent purchased the Plot bearing no.117 from the original allottee and undertaking illegal construction. Alleging that in spite of making complaints against such illegal construction, no action has been taken, this writ petition is filed.

Heard Sri P.R.K.Amarendra Kumar, learned counsel for petitioner, learned Government Pleader for Municipal Administration (AP) for respondent no.1 and Sri Ancha Pandu Ranga Rao, learned standing counsel for respondents 2 and 3. With the consent of learned counsels, this writ petition is disposed of finally at the admission stage. 3.
Learned standing counsel, on instructions, submits that though online building permission was granted, the authorities of Municipal Corporation have inspected the subject building and found deviations in the construction and appropriate action is being initiated by the Municipal Corporation.

Having regard to the said submission, no further orders are required in the writ petition. Writ petition is disposed of, directing the respondent Corporation to take appropriate course of action as warranted by law on the alleged deviations by the 4th respondent by putting him on notice and affording due opportunity. It is made clear that there is no expression of opinion on merits and all claims of the 4th respondent are preserved to be agitated as and when notice is issued to him. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
