HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9840 of 2016 O R D E R:- Heard learned counsel for the petitioners, learned Government Pleader for Panchayat Raj appearing for the respondents 1 to 3, and Sri Ravi Cheemalapati, learned counsel for the respondents 4 and 5.

This writ petition, under Article 226 of the Constitution of India, is filed seeking a Writ of Mandamus to declare the inaction of the 4th respondent in conducting enquiry and including the names of the petitioners in the pension list, on their application dated 11.01.2016, as illegal, arbitrary and contrary to G.O.Ms.No.135, Panchayat Raj and Rural Development (RD.I) Department, dated 17.09.2014. As it is the main grievance of the petitioners that though they made an appeal to the 4th respondent on 11.01.2016 seeking to conduct a detailed enquiry, examine the records, include their names in the pension list and pay the pension to them, the 4th respondent has not conducted enquiry as on today; this Court is of the view that the writ petition can be

disposed of at the admission stage with a direction to the 4th respondent to consider and dispose of the appeal of the petitioners.

Accordingly, the Writ Petition is disposed of at the admission stage directing the 4th respondent to consider the grievance of the petitioners as raised in their appeal dated 11.01.2016, if pending, and pass orders with regard to their eligibility, within six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
