HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No. 154 OF 2015.

ORDER:

It is the case of the petitioner that he is living in a small hut situated adjacent to the fourth respondent-temple for the last more than 30 years. It is his further case that he is also serving the fourth respondent-temple. It is the grievance of the petitioner that the fourth respondent-temple issued a notice on 01.12.2014 directing him to vacate the hut in which he is living. The petitioner submitted his explanation to the said notice on 14.12.2014 stating that the other similarly situated persons who were evicted have been provided with alternative arrangement. It is the further grievance of the petitioner that without passing any orders on the representation/explanation submitted by him on 14.12.2014, the fourth respondent-temple is trying to evict him from the said hut.

Heard the learned Counsel for the petitioner, learned Government Pleader for Respondents 1 to 3 and Sri VTM Prasad, learned Standing Counsel for the fourth respondent.

Having regard to the peculiar facts and circumstances of the case, the Writ Petition is disposed of directing the respondents to consider the representation/explanation stated to have been submitted by the petitioner on 14.12.2014 pursuant to the notice dated 01.12.2014 and pass appropriate orders thereon. Till then the respondents shall not evict the petitioner from the said hut.

Subject to the above direction, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed.
