Heard learned counsel for petitioner, learned Government Pleader for Panchayat Raj and Rural Development appearing for respondent Nos.1 to 4 and Sri G.Seshadri, learned Standing Counsel for 5th respondent.

The petitioner has filed this Writ Petition challenging the proceedings dt.02-11-2016 issued by 4th respondent placing the petitioner under suspension pending enquiry and to submit explanation against certain charges framed against petitioner. 3.

The petitioner has submitted his explanation to the said charge memo on 08-11-2016.

Petitioner contends that there is no substance in the charges framed against petitioner and therefore there is no necessity to place the petitioner under suspension.

I am not inclined to go into the correctness or otherwise of the charges framed against petitioner since petitioner would have adequate opportunity to defend himself in the enquiry which is proposed to be conducted pursuant to the charge memo issued to petitioner.

Therefore, the Writ Petition is disposed of directing the respondents to consider petitioner's explanation to the charge memo issued to petitioner, conduct enquiry in accordance with law and pass a reasoned order and communicate the same to petitioner within three

(03) months from the date of receipt of a copy of this order. No costs. 7.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
