The Court made the following :

ORDER: (per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This Writ Petition is filed for the following substantive relief :

" ... to issue a writ or direction or an order particularly in the nature of writ of mandamus declaring action of the respondent Bank in issuing the possession notice dated 18-6-2016 against petitioner's property bearing Flat No.T-2, on Third Floor of Redcon Residency, admeasuring 760 Sq.Ft. (including common areas together with undivided share in the land measuring 20 Sq. Yrds., out of 500 S q . Yds. In premises bearing Municipal No.6-31140/T, situated at JHK Mansion, Somajiguda, Hyderabad as illegal, arbitrary, violation of principles of natural justice and violation of fundamental rights guaranteed under Constitution of India and contrary to the provisions of SARFAESI Act and to set-aside the same ..."

On 16-8-2016, the case was adjourned to today at the request of the learned Counsel for the petitioner. Today, when the case was called in the pre-lunch session, there was no representation. Therefore, the case was passed-over. Even in post-lunch session, no one represented the petitioner when the case was

called. Hence, it is reasonable to presume that the petitioner is not interested in pursuing his cause in the Writ Petition.

The Writ Petition is accordingly dismissed for nonprosecution. As a sequel to the dismissal of the Writ Petition, WPMP No.33693 of 2016 filed for interim relief is dismissed.
