The present Criminal Petition came to be filed by the petitioners/A.1 to A.3 under Section 438 Cr.P.C., seeking release in the event of their arrest in crime no.192 of 2016 of Bowenpally police station, Hyderabad District registered against them for the offence punishable under Section 3 (1) (r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. 2.

It is alleged in the report lodged by the informant that her neighbours occupied 50 square yards of land illegally thereby blocking passage way. A.3 and her family, without there being any authorized patta or a registered deed in respect of the said 50 square yards, intentionally built a bath room in a shed to be south facing causing blockage to the passage for the last 2 years, and not allowing her to have ingress or egress to her house. It is further alleged that the accused rebuked her in filthy language touching upon her caste. Basing on these allegations, the present case came to be registered. 3.

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

Having regard to the circumstances of the case, the petitioners are at liberty to surrender before the concerned Court and move an application for grant of regular bail after giving prior notice to the Public Prosecutor concerned, in which event, the petitioners shall be released on bail on such terms and conditions as the said Court deems fit and proper 5.
