The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the 2nd respondent in seeking to acquire the plot bearing No.61 in Survey No. 296, admeasuring 468.88 sq.yards or 392.04 sq.mts., situated at Block No.2, Cherlpally Village, Kapra Mandal, Medchal-Malkajgiri district, without initiating proceedings under the law or without following the procedure established under law, as illegal, arbitrary and improper. 2.
The learned counsel for the petitioner would submit that without any authority of law, the authorities of the 2nd respondent-Corporation are demarcating the subject land for the purpose of digging a septic tank.

The learned Standing Counsel for the 2nd respondentCorporation, Sri Sampath Prabhakar Reddy would submit that the allegations made in the affidavit relating to making of a place for digging a septic tank and the authorities are interfering with the subject land, are false. However, he would submit that if any action is to be taken, the same would be in accordance with law.
