ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.1 to 7 in FIR No.208 of 2025 before the Inavole Police Station, Warangal District, registered for the offences punishable under Section 292, 118(1), 351(2) of the Bharatiya Nyaya Sanhita (for short 'BNS') r/w Section 90 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS').

The case of the prosecution is that the de-facto complainant, lodged a report before the police on 14.12.2025 stating that, on 14.12.2025, when the de-facto complainant and his brother-in-law were returning from the poling booth, all the accused allegedly quarreled with them and abused them in filthy language and assaulted the de-facto complainant with the stone, resulting in an injury to the right hand finger, as such requested the police for taking necessary action. On receipt of the said complaint, the Police registered case against the petitioners for the offences as alleged. After obtaining the injury certificate, the offence under 118(1) of the BNS was altered to Section 118(2). Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioners. 3.
Heard Sri A. Prabhakar Rao, learned counsel for the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and that there are no specific allegations against the accused having assaulted the injured with a stone. It is further contended that mere
alteration of the offence from Section 118(1) of the BNS to Section 118(2), cannot establish that the injury was of such a nature as to cause the death of the victim. It is further submitted that the injury sustained is only to the middle finger of the right hand and that the petitioners are willing to cooperate with the investigating authority. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that all the accused assaulted the victim and that the victim sustained a grievous injury, namely a fracture to the finger. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition. 6.
In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners herein are arrayed as accused Nos.1 to 7 for the alleged offences and as seen from the record the de-facto complainant made a complaint against all the accused, stating that they assaulted him. However, there is no
specific allegation to indicate which accused caused the fracture injury. There are no other cases pending against the petitioners. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to compliance of the following conditions: i.
The petitioners shall surrender before the Station House Officer, Inavole Police Station, Warangal District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
