HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Petition No.8768 of 2015 ORDER:

This criminal petition is filed by the petitioner/accused, under sections 437 and 439 Cr.P.C., seeking bail in Crime No.15 of of Annavaram Police Station, Visakhapatnam District, registered for the offences punishable under Sections 20(b) and 8(c) of NDPS Act. The brief case of the prosecution is that on 19-062015, the Respondent-Police, on credible information, came t o Lothugedda Bridge and while conducting vehicle checking, Driver of an auto No.AP 31 TC 0945 who was carrying five gunny bags, on seeing the respondent-police, tried to escape, but the respondent-police could apprehend him and found 130 Kgs. of ganja.

As the quantity of ganja seized from the petitioner - accused is 130 Kgs., which is commercial quantity, this Court is not inclined to grant bail to the petitioner - accused at this stage.
