THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 9030 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "The Hon'ble Court may be pleased to issue a Writ or Order or direction or a writ particularly in the nature of Writ of Mandamus declaring that the action on the part of the respondents in arranging to transfer petitioner's son by name Shaik Abdul Khaja, under trial prisoner in SC No.359 of 2006 in violation of the Prisons Act and highly unconstitutional, consequently, this Hon'ble court may be pleased to direct the respondents not to transfer/shift petitioner's son by name Shaik Abdul Khaja under trial prisoner in S.C.No.359 of 2006 to Warangal Central Prison or any other Jail form Chancalguda Central Jail and pass any other order or order." 2.

The Superintendent of Central Prison, Hyderabad, furnished instructions to the office of the learned Government Pleader for Home, wherein he stated that his office has not submitted any proposal to transfer Shaik Abdul Khaja, the son of the petitioner, from Central Prison, Hyderabad, to any prison as on date.

3. Sri Mohd. Adnan, learned counsel for the petitioner, would submit that it would suffice if the aforestated stand of the prison authorities is taken on record.

The Writ Petition is accordingly closed recording the submission made by the Superintendent of Central Prison, Hyderabad, as afore-stated. Needless to state, in the event any proposal is made to shift the petitioner's son from the present jail, the authorities shall follow due procedure laid down by law in that regard.
